إن حقوق الملكية الفكرية تلعب دورا مهما وجوهريا في تنمية الاقتصاد والدفع بعجلة التقدم والتطور لأي بلد يولي الاهتمام بهذا النوع من الحقوق، وهي تنقسم إلى قسمين يتعلق الأول بحقوق الملكية الأدبية والفنية والذي بدوره يضم حقوق المؤلف والحقوق المجاورة، أما الشق الثاني فيضم حقوق الملكية الصناعية والتجارية سعت الجزائر ومنذ الاستقلال إلى يومنا هذا إلى إنشاء منظومة قانونية الحماية هذه الحقوق وتطويرها عن طريق توفير حماية مدنية و أخرى جزائية ، ولم يقتصر الأمر على حماية حقوق الملكية الفكرية داخليا وإنما عززت هذه الحماية بانضمام الجزائر إلى أهم الاتفاقيات الدولية المتخصصة في هذا المجال .

Les droits de la propriété intellectuelle jouent un rôle important et fondamental dans la croissance économique et poussent la roue de l'avancement et du développement pour chaque pays qui privilège ce type de droit.. Ces droits comportent deux parties, la première concerne les droits. littéraire et artistique qui intègrent en elle-même les droits d'auteure et les droits de proximité, la deuxième contient les droits de la propriété industrielle et commerciale. L'algérie, et depuis son indépendance à nos jours, tâche de construire un organisme judiciaire pour protéger ces droits et les développer å travers l'assurance d'une protection civile et pénale. L'algérie n'a pas limité cette protection des droits de la propriété intellectuelle au niveau national mais elle la renforcer par son association aux plus importantes conventions internationales spécialisées dans ce domaine.

A country whose the main interest is development, is mainly aware about giving importance to the intelectual rights which play a crucial role in pushing the economy of the country, in concern, through prosperity. Rights are, in fact, devided into to parts; the first one is concerned with the literary and artistical ones, protecting the right of the writer and neighboring. While, the second compasses the industrial and commercial ones. Algeria, from independence till nowadays is still working hard to establish a legal organisation to protect and develop these rights through providing a civilization and a penal protection. Moreover, there is a certain initiative to reinforce this protection of the intellectual rights inside and outside the country by contributing to the most important international conventions which are specialised in these domains.
